Participant Waiver, Release of Liability, and Rules

1. Waiver and Release of Liability (Agreement):

By clicking “I Agree”, you acknowledge and agree that your use of the facilities is voluntary, and the equipment and services provided by Cottage Street Golf involves inherent risks, including, but not limited to, injury, property damage, or loss. You personally voluntarily assume all risks for yourself and any guest you invite into the facility, whether foreseeable or not, associated with your use of the golf simulator, equipment, and any related activities conducted on the premises. Accordingly, In consideration of the opportunity to use the Cottage Street Golf building, golf simulator, and related equipment and components, I agree to the following:

  1. I hereby release and hold harmless Cottage Street Golf, its officers, directors, employees, agents, volunteers, and contractors (collectively known as Releasees) from any claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these Risks (Claims), including those caused by the negligent acts or omissions of any or all of the Releasees.
  2. I recognize the physical exertion involved in the use of the building, golf simulators, and related equipment, and attest and certify that I am physically fit to participate safely, and I have not been advised otherwise by a health care professional. You acknowledge that Cottage Street Golf does not provide medical personnel or treatment on-site. In the event of a medical emergency, you authorize Cottage Street Golf to seek medical attention on your behalf, and you assume all costs associated with such care.
  3. I will be solely responsible for any and all medical and related bills that I may incur because of any injury, as well as costs related to loss or damage to my property, that I may sustain as a result of my participation in activities at Cottage Street Golf.
  4. I will be personally liable for any and all damage to the building, simulators, and related equipment caused by my careless, reckless or intentional actions.
  5. This Agreement shall be binding on my estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on my behalf or on behalf of my estate.

2. General Provisions:

  1. I hereby expressly agree that (1) this Agreement shall be governed and construed according to the laws of the Commonwealth of Massachusetts without regard to its conflict of laws provisions and (2) any action or proceeding concerning any Claim or the meaning or effect of any provision of the Agreement shall be conducted only in the courts located in Hampshire County, Massachusetts, or in the Federal District Court for the Commonwealth of Massachusetts, and that for such purposes, I expressly submit to the jurisdiction of such courts.
  2. This Agreement contains the entire understanding between and among the parties concerning these matters. No waiver, modification, or amendment of any of the terms of this Agreement shall be effective unless made in writing and signed by the party to be charged.
  3. I hereby expressly agree that if any portion of this Agreement is held invalid, the balance of the Agreement shall nonetheless continue in full legal force and effect. I warrant that I have read and understand that this Agreement involves my waiver and release of significant rights and my assumption of significant indemnification responsibilities in participating in the Event.
  4. By clicking “I Agree,” you consent to Cottage Street Golf using photographs or video recordings of you taken during your use of the facility for marketing and promotional purposes, without compensation. [You may opt out of this clause by contacting us directly.]


3. VENUE SAFETY RULES AND REGULATIONS: 

I agree to follow procedures and safety rules described in the Rules and Regulations (available on the Cottage Street Golf website), which are intended to protect the players, spectators and other guests.

Rules and Regulations:

  • You may not give your Membership Code to anyone else. Doing so will result in termination from the Program. You are responsible to make sure any guests you bring into the simulator follow the rules listed below.
  • You may only use your code during a previously scheduled tee time; using the code to enter the building at any other time will be considered trespassing and will result in dismissal from the membership program.
  • Absolutely NO smoking, vaping or drugs allowed inside the building.
  • Alcoholic beverages are permitted, but in moderation only and all containers must be put in recycling.
  • Food may be consumed in the simulator, but must be fully cleaned up afterwards and trash and recycling put in the proper receptacles. NO FOOD OR DRINK IN THE HITTING AREA or near the computer at any time!
  • Please ensure you have CLEAN SHOES and CLEAN CLUBS.
  • During winter months, no shoes worn outside are allowed in the hitting area. Please bring a clean pair of dry shoes.
  • You must stay in designated areas only, which includes the main simulation area and the bathroom. Please do not enter the doors to the shop if they are left unlocked or the office behind the screen unless given express permission.
  • No more than 4 golfers are allowed in after hours without prior approval.
  • Be respectful of other guests.
  • No children under the age of 10 with out supervision from a non-golfing adult.
  • Only one person should be present in the hitting area at a time. Everyone MUST keep a safe distance, and keep watch of the person golfing.
  • Before you swing any club, check your surroundings to ensure no one or obstacle is within your range of swing.
  • Be aware of your backswing and follow-through at all times.
  • Your shot must be directed towards the hitting screen.
  • Swinging should always take place near the hitting area of the mat.
  • Be alert of where you stand or walk and stay out of someone’s range of swing.
  • Report any accidents immediately.
  • Customers are financially responsible for any damage caused by failure to follow the directions of the Rules and Regulations.
  • Customers acknowledge Cottage Street Golf is under video surveillance. Tampering with a camera system or damaging equipment by not following procedures in the guidelines will result in financial compensation being paid to Cottage Street Golf.
  • We would love for you to be able to finish your “last hole”, but you must finish your session and vacate the facility no more than 10 minutes after your reserved time ends.
  • Leave the room as you found it; balls and tees picked up and put away and the room left neat and clean.
  • When finished, turn off the projector, the large TV in the corner, and all lights.
  • After locking the door, verify that the door is locked by turning the knob and pushing on the door.
  • Above all, treat our facility with respect; keeping it clean, undamaged, and in good working order.
  • Failure of you or your guests to abide by any of the above procedures may result in the cancellation of the remainder of your paid simulator time without compensation.

By clicking “I Agree,” I confirm that I have read, understood, and agreed to the terms of this Waiver of Liability for myself and all of my guests. If agreeing on behalf of a minor, you confirm that you are the parent or legal guardian and accept all responsibilities outlined herein.

I HEREBY ACKNOWLEDGE (1) THAT THIS DOCUMENT IS VALID AND MAY BE ENFORCED IN THE SAME MANNER AS A HAND-SIGNED DOCUMENT THAT EXISTS IN PHYSICAL FORM. I ALSO EXPRESSLY ACKNOWLEDGE THE VALIDITY OF THIS DOCUMENT. I FURTHER AGREE THAT I HAVE KNOWINGLY AND EXPLICITLY WAIVED ANY RIGHT TO CLAIM THIS DOCUMENT IS INVALID OR IS UNENFORCEABLE BASED ON THE FACT THAT I HAVE NOT PUT PEN TO PAPER.
